1) Purpose and scope of application
These General Conditions are intended to regulate the relationship between Cellers Scala Dei, SA (hereinafter, Cellers Scala Dei and/or the Company) and you (hereinafter, the Customer), relating to all transactions carried out in the Company's online store.
Cellers Scala Dei is a Spanish company, registered in the Mercantile Registry of Tarragona, Book 0, Volume 1,688, Folio 62, with CIF number A-08367690 and registered office at Scala Dei, 43379. (Tarragona), Avenida Rambla de la Cartoixa, without number.

2) Exclusions
The sale of alcoholic beverages of any strength to minors is prohibited.
Likewise, the products offered by Cellers Scala Dei through the Company's online store are not directed to countries in which the consumption of alcoholic beverages is prohibited.
3) Acceptance and acceptance testing
The acquisition of the products will be made by activating the ADD TO BASKET button that appears at the footer of the purchase request, and expresses full acceptance of these General Conditions prior to the acquisition of the products, without any new developments that may occur in the clauses of the General Conditions subsequently being applicable.
Cellers Scala Dei will send the Client, once these General Conditions have been expressly accepted, justification of the contract made, with all its terms, via email within 24 hours of the purchase.
Cellers Scala Dei informs you that it archives the electronic documents in which purchases are formalized.
In the event that the Client makes an error in the data, they may modify them in the Customer Service section, by calling 977 827 027, or by writing to web@cellersdescaladei.com. If the modified data refers to the postal address where the Client has requested that the purchased product be delivered, and provided that the product has not already been sent, this shipment will be made to the new address indicated. Otherwise, the Client must wait for the delivery to become effective, and then initiate the appropriate return procedures, as detailed in section 4.4. following.
4) Prices, Payment Method, Delivery and Withdrawal
4.1 Prices
The prices applicable to each product are those indicated on the website on the date of the order, including all VAT (Value Added Tax) and other taxes that may apply.
The offers will be duly marked and identified as such, conveniently indicating the previous price and the offer price.
Cellers Scala Dei reserves the right to make any modifications it deems appropriate on the website at any time and without prior notice, and may update products and services daily based on the market.
The corresponding shipping costs are always indicated in the order.
4.2 Payment method
Once the Client has confirmed the purchase of the product, they must proceed to pay the indicated amount. Purchases can be paid by any of the following means:
– Through the payment gateway of the “La Caixa” entity.
– Through PayPal (you can pay with your PayPal account or with your debit or credit card).
– Bank transfer is a form of payment exclusively enabled for companies.
In order for Cellers Scala Dei to carry out the appropriate procedures, the Client will notify Cellers Scala Dei, as soon as possible, of any improper or fraudulent charges. Notification may be made to the email address or by calling the telephone number indicated above.
4.3 Delivery
Deliveries are sent to the delivery address indicated by the Customer, within a period of 24 to 72 working hours for deliveries in the Iberian Peninsula, and 7 days for the Balearic Islands and Andorra and 14 days for Ceuta, Melilla and the Canary Islands for products in stock. The provision of services will be carried out from Monday to Friday, excluding holidays in the destination location from the time calculation.

In the event of non-compliance with the delivery deadline, the compensation to be paid will consist of the return of the ports paid by the client. Non-compliance with the delivery deadline will not be considered to be one caused by the absence or change of address of the recipient, unknown recipient or address, non-payment of postage, advance payments or refunds, closure due to holidays, late deliveries in a second delivery attempt, causes of force majeure or fortuitous event or others not attributable to the carrier. Likewise, it is exempt from liability in cases of non-compliance with the delivery deadline for shipments in the Balearic Islands or international shipments due to causes beyond the control of the carrier (delays by airlines, maritime companies, carriers, loading and/or unloading...).
4.4 Withdrawal
Cellers Scala Dei guarantees the Customer the possibility of canceling their order at any time and without any cost, provided that the cancellation is communicated before the order has been made available to the carrier for shipment. Otherwise, you must wait to receive the order to process the return.
The Client will have a period of seven business days from the formalization of the purchase to terminate the contract.
The Client will inform Cellers Scala Dei, within the stipulated period and by any means permitted by law, of their desire to exercise the right to withdraw from the contract.
The returned order must be delivered together with the delivery note and, where applicable, an invoice issued by Cellers Scala Dei, current Cellers Scala Dei with the return costs. The Client may return any item purchased at Cellers Scala Dei as long as the products have not been opened or used, and retain their original seal or packaging.
Once the withdrawal request has been processed, the amounts disbursed by the Client will be paid as soon as possible, in any case within thirty days following receipt of the withdrawal request.
If a product other than the one requested by the Client is delivered in error by Bodegas Scala Dei, the correct product will be delivered by collecting the previous one without any additional charge for the Client.
If a product has arrived to the customer broken, damaged or in poor condition, Cellers Scala Dei will be responsible for collecting it from their home, replacing it with another one in good condition without additional charges.

5) Language
The language in which the contract between Cellers Scala Dei and the Client will be perfected will be Spanish, Catalan or English, depending on the language selected on the website.
6) Responsibilities of Cellers Scala Dei
Cellers Scala Dei guarantees the quality of the service contracted through the website. All the rights that current legislation grants to consumers and users are guaranteed.
Failure to comply with any of these General Conditions may result in the return of the products or the cancellation of the Services purchased by the Client.
7) Client Responsibilities
The Client undertakes to make lawful use of the Products and Services, without contravening current legislation or harming the rights and interests of third parties.

9) Jurisdiction and applicable law
In the event of conflicts in the interpretation or application of these contractual conditions, in the case of end consumers, in accordance with the applicable regulations, the Courts of the place of fulfillment of the obligation or the domicile of the purchasing party will be competent.
In the case of a sale carried out by a company, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Tarragona (Spain).

(hereinafter, “CELLERS DE SCALA DEI” and/or the “Company”) and you (hereinafter, the “Client”), regarding all transactions carried out through the website cellersdescaladei.com (hereinafter, the “Website”) consisting of reservations for visits and activities of the Company (hereinafter, the “Services”).
2) Exclusions
The provision of the Services through the Website to minors under 18 years of age who are not accompanied by an adult is prohibited.
Likewise, the Services offered by CELLERS DE SCALA DEI through the Website that involve the consumption of alcoholic beverages of any strength are prohibited to minors under 18 years of age.
3) Acceptance and acceptance testing

4.4 Reservation Cancellation

However, the Client may change the visit to another date to be agreed with the winery and for a maximum period of 1 year.
CELLERS DE SCALA DEI reserves the right to unilaterally modify the content, route, alter the duration of the visit for reasonable reasons, such as rain, fog or other weather conditions, construction, lack of electricity supply, mechanical or computer failures, etc...
In the event that CELLERS DE SCALA DEI cancels the visit for reasons attributable to the Company before its start, there will be the right to refund the amounts paid.

5) Responsibilities of CELLERS DE SCALA DEI
